UPON APPEAL from the Order of the Honourable
Mr. Justice Macfarlane, pronounced the 3rd day of July,
A.D. 1970, and entered the 15th day of July, 1970 having
come on for hearing before this Court in the City of
Vancouver, British Columbia, on the 1st day of April, 1971,
AND UPON HEARING READ the Appeal Books, AND UPON HEARING
A.L. van der Horst, Esq., of Counsel for the Respondent;
THIS COURT DOTH ORDER AND ADJUDGE that this
Appral be allowed to the extent of amending the Order of The
Honourable Mr. Justice Macfarlane by the addition of the
following words after the word “ADJUDGE” in the two operative
paragraphs of the said Order:
” That until further order of this Court,
not to be made until three years from the
expiration of this date,”
so that, as amended, the Order will read:
” THIS COURT DOTH ORDER AND ADJUDGE
that until further Order of this Court, not to
be made until three years from the expiration
of this date, no legal proceedings shall, without
leave of the Court or a Judge thereof, be
instituted by William David Michael Grosvenor in
any Court;
AND THIS COURT DOTH FURTHER ORDER
AND ADJUDGE that until further Order of this
Court, not to be made until three years from
the expiration of this date, William David
Michael Grosvenor shall not counsel the
commencement of legal proceedings in any court
by other persons or institute legal proceedings
in any court as an officer of any company or
member of any firm without leave of the Court or
a Judge thereof.”
AND THIS COURT DOTH FURTHER ORDER AND ADJUDGE
that, save as herein provided, this Appeal is dismissed
without costs to either party.
