BBC argued that it merited intervenor status because of its expertise in the Nazi war crimes issue. The Federal Court of Appeal hearing (January 20-21, 1997) is a result of a decision by Federal Court Justice James Jerome to grant judicial review in the case against Nemsila. Justice Jerome found that an Immigration Adjudicator had erred in an earlier ruling that Nemsila was protected by an obscure 1910 law protecting landed immigrants who have been in Canada for more than five years. The Federal Court of Appeal will be examining questions certified by Justice Jerome. B'nai Brith Canada's legal team is headed by David Matas, BBC's senior legal counsel and Canada's foremost legal expert on immigration and war crimes issues. Frank Dimant, Executive Vice-President of B'nai Brith Canada issued the following statement: As the leading Jewish advocacy organization, B'nai Brith Canada is pleased to be actively contributing to the Federal governments case against Nemsila. It is vital that B'nai Brith and other Jewish organizations have the opportunity to provide their invaluable expertise in the prosecution of alleged Nazi war criminals. B'nai Brith is fortunate to have a pool of outstanding volunteers, including lawyers and historians, working on the war crimes portfolio. Nemsila has been convicted in absentia in his native Slovakia for being a district commander of the notorious Hlinka Guard.
