Invisible man loses tax war

NELSON - Tax-fighter Ron Vinkle says he won the
battle and lost the war.
He was acquitted on a technicality of five counts
of failing to file an income-tax return.
But Vinkle, 48, a carpenter from Kaslo, had wanted
to argue whether Ottawa has the right to tax him.
"I wanted this to go farther," he said. "I wanted to
take it right back to the Magna Carta."
Vinkle, who says he has never paid income tax, filed
returners from 1990 to 1994 marked "N/A."
His lawyers, Doug Christie and Don Skogstad, said
he was charged under the wrong section on the Income 
Tax Act, and provincial judge Donald Sperry agreed.
But the judge rejected the assertion that the Crown
had failed to prove Vinkle was a person.
Vinkle has no medical services plan number or social
insurance number and regards himself as "invisible."
Looking at Vinkle, Sperry said: "Mr. Vinkle is a person."
Vinkle is to appear again in three weeks on five more
counts of failing to file tax returns, from 1985 to 1989.

Reasons for the Decision of the Supreme Court of Canada
3 October, 1950

The Chief Justice:- "The Parliament of Canada and the Legislatures of the
several Provinces are sovereign within their sphere defined
by the British North America Act," "They can exercise only the
legislative powers respectively given to them by
sections 91 and 92 of the Act, and these powers must be
found in either of these sections.

The constitution of Canada does not belong either to
Parliament, or to the Legislatures; it belongs to the country 
and it is there that the citizens of the country will find the
protection of the rights to which they are entitled. It is
part of that protection that Parliament can legislate only
on the subject matters referred to it by section 91 and that
each Province can legislate exclusively on the subject
matters refered to it by section 92."

"No power of delegation is expressed either in section 91
or in section 92, nor, indeed, is there to be found the power
of accepting delegation from one body to the other; and
I have no doubt that if it had been the intention to give
such powers it would have been expressed in clear and
unequivocal language. " "Under the scheme of the British
North America Act there were to be, in the words of Lord
Atkin in The Labour Conventions Reference "water tight
compartments which are an essential part of the original
structure."
"Neither legislative bodies, federal or provincial, possess
any portion of the powers respectively vested in the other
and they cannot receive it by delegation. In that connection
the word "exclusively" used both in section 91 and in 
section 92 indicates a settled line of demarcation and it
does not belong to either Parliament, or the Legislatures, to
cofer powers upon the other."

Kerwin J.:- "As to the power of the Dominion Parliament to
delegate its powers I have no doubt." This statment was obiter
and if it means more than that Parliament could
delegate as it did in the Chemicals Reference case, it is contrary to
what has already been said in Citizen's Insurance C. v. Parsons,
by Taschereau j. at 317: "But the Federal Parliament cannot amend the 
British North America Act, nor give, either expressly or impliedly to
the local legislatures, a power which the Imperial Act does
not give them."

Now, I could go on for pages, but, I think you get the point.

The Income Tax Act is a power-sharing agreement that is outside
the powers vested in either section 91 and 92, and it unconstitutional.

"Secret agenda"

The gun lobby says it finally has proof of Ottawa's "secret agenda"
to disarm the Canadian people - courtesy of Senator
Sharon Carstairs.
But Carstairs claims foes of the new gun-control
law have stooped to concocting false and alarmist statements
in a bid to keep their movement alive.
"I think it's a sign of their frustration," said Carstairs, who
successfully shepherded Bill C-68 through the Senate
in November.
The gun lobby claims Carstairs was speaking at a 
sparsely attended forum in Winnipeg two weeks ago when
she let it slip Ottawa's real goal wasn't to control crime and
violence but to "socially engineer society."
The gun lobby quickly spread its interpretation on the Internet,
which in turn sparked a letter writing campaign to Mps,
senators and the media announcing "the secret agenda is out
of the bag."
But Carstairs says the Manitoba gun lobby isn't telling the truth.
"There's no way I ever used those words," she said.
Carstairs insisted she has always stuck to the same message
mandatory registration will make society safer.
"I was sitting right next to her and heard her say it but I can't
prove it," countered Larry Tardiff, president of the Council
for Responsible Firearms Ownership, Manitoba.

Canadian Income Tax is unconstitutional.

     Yes people of Canada it's that time of year again. Revenue 
Canada will be gearing up to ensure that you all pay your fair
share of "income tax." The question is; where does the
government of Canada get it's authority to directly tax the
people? If you understand anything about law, you know
the government must consult our Constitution, commonly called the BNA
Act. Does the BNA Act give the government the authority to
tax the people directly? The answer is a resounding NO! 

     Now that you are asking yourself what planet did this guy
come from, let me explain to you what I mean. Because of media
censorship, you probably have never heard about a man named
Gerald Hart. Gerry was commonly known as "Taxfreeman,"
because he didn't paid income tax for over 40 years. 
Taxpayers of Canada, if you want to fully understand
the story of Gerald Hart, and how you too can avoid being
a victim of the extortion of Revenue Canada, I urge you
get for yourselves a set of these books.

     This two book set is complete with all the information
you need to better inform yourself about Canadian law, and
how the government of Canada is to this day breaking it.
This set of books includes the BNA Act, and all relevant
documents as how the Government of Canada has not, and
cannot change the Constitution regarding direct taxes.
Our Constitution gave the right of direct taxes to the Provincial
government for Provincial purposes only. Also included in this set of
books, is the Supreme Court of Canada's decision of
October 3, 1950. The SCC told the federal government it has no
right to engage in power sharing agreements that the Constitution exclusive
gave to the provinces. This included the Income Tax act.

     People all across Canada are now using the Heart method
of Effective Tax Avoidance. If your sick and tired of all your
hard-earned money going to a corrupt federal government, take the

Key sections of the BNA ACT 1867

1) Section 91 and 92 deals with the powers of the Parliament of Canada
and the powers of the Provincial government.

91 reads  

               VI. Distribution of Powers

     91. It  shall be Lawful for the  Queen, by and with the Advice
     and Consent of the Senate and  the House of  Commons,  to make
     Laws for  the Peace, Order  and Good Government of  Canada, in
     relation  to all  Matters  not coming within   the  Classes of
     Subjects by this Act assigned  exclusively to the Legislatures
     of the Provinces; and for greater  Certainty, but not so as to
     restrict the Generality of the foregoing Terms of the Section,
     it is  hereby declared that  (notwithstanding anything in this
     Act) the exclusive Legislative Authority of  the Parliament of
     Canada extends  to  all Matters  coming  within the Classes of
     Subjects hereinafter enumerated; that is to say,

          1.  REPEALED.
          1A. The Public Debt and Property.
          2.  The Regulation of Trade and Commerce.
          2A. Unemployment insurance.
          3.  The Raising of Money by any Mode or System of
              Taxation.
          4.  The borrowing of Money on the Public Credit.
          5.  Postal Service.
          6.  The Census and Statistics.
          7.  Militia, Military and Naval Service, and Defence.
          8.  The fixing of and providing for the Salaries and
              Allowances of Civil and other Officers of the
              Government of Canada.
          9.  Beacons, Buoys, Lighthouses, and Sable Island.
          10. Navigation and Shipping.
          11. Quarantine and the Establishment and Maintenance 
              of Marine Hospitals.
          12. Sea Coast and Inland Fisheries.
          13. Ferries between a Province and any British or
              Foreign Country, or between two Provinces
          14. Currency and Coinage
          15. Banking, Incorporation of Banks, and the Issue of
              Paper Money
          16. Savings Banks
          17. Weights and Measures
          18. Bills of Exchange and Promissory Notes
          19. Interest
          20. Legal Tender
          21. Bankruptcy and Insolvency
          22. Patents of Invention and Discovery
          23. Copyrights
          24. Indians, and Lands reserved for the Indians
          25. Naturalization and Aliens
          26. Marriage and Divorce
          27. The Criminal Law, except for the Constitution of
              Courts of Criminal Jurisdiction, but including the
              Procedure in Criminal Matters.
          28. The Establishment, Maintenance, and Management of
              Penitentiaries.
          29. Such Classes of Subjects as are expressly excepted
              in the Enumeration of the Classes of Subjects by
              this Act assigned exclusively to the Legislatures
              of the Provinces.

     And  any Matter coming  within any  of the Classes of Subjects
     enumerated in this Section shall not be  deemed to come within
     the Class of matters of a local or private Nature comprised in
     the    Enumeration of the Classes  of    Subjects by this  Act
     assigned exclusively to the Legislatures of the Provinces.


          Exclusive Powers of the Provincial Legislatures

     92. In each Province the Legislature may exclusively make Laws
     in relation  to matters coming  within the Classes  of Subject
     next hereinafter enumerated; that is to say, --

          1.  REPEALED.

          2.  Direct Taxation within the Province in order to
              the raising of a Revenue for Provincial Purposes.
          3.  The borrowing of Money on the sole Credit of the
              Province.
          4.  The Establishment and Tenure of Provincial Offices
              and the Appointment and Payment of Provincial
              Officers.
          5.  The Management and Sale of the Public Lands
              belonging to the Province and of the Timber and
              Wood thereon.
          6.  The Establishment, Maintenance, and Management of
              Public and Reformatory Prisons in and for the
              Province.
          7.  The Establishment, Maintenance, and Management of
              Hospitals, Asylums, Charities, and Eleemosynary
              Institutions in and for the Province, other than
              Marine Hospitals.
          8.  Municipal Institutions in the Province.
          9.  Shop, Saloon, Tavern, Auctioneer, and other
              Licences in order to the raising of a Revenue for
              Provincial, Local, or Municipal Purposes.
          10. Local Works and Undertakings other than such as
              are of the following classes:
               (a) Lines of Steam or other Ships, Railways,
               Canals, Telegraphs, and other Works and
               Undertakings connecting the Province with any
               other or others of the Province, or extending
               beyond the Limits of the Province;
               (b) Lines of Steam Ships between the Province
               and any British or Foreign Country;
               (c) Such Works as, although wholely situate
               within the Province, are before or after their
               Execution declared to be for the general
               Advantage of Canada or for the Advantage of
               Two or more of the Provinces.
          11. The Incorporation of Companies with Provincial
              Objects.
          12. The Solemnization of Marriage in the Province.
          13. Property and Civil Rights within the Province.
          14. The Administration of Justice in the Province,
              including the Constitution, Maintenance, and
              Organization of Provincial Courts, both of Civil
              and of Criminal Jurisdiction, and including
              Procedure in Civil Matters in those Courts.
          15. The Imposition of Punishment by Fine, Penalty, or
              Imprisonment for enforcing any Law of the Province
              made in relation to any Matter coming within any
              of the Classes of Subjects enumerated in this
              Section.
          16. Generally all Matters of a merely local or private
              Nature in the Province.

You must ask yourself this basic question: Who has more rights
the majority or the minority? Canada is a so-called democracy right? 
if this is so, why is it the minorities have all the rights?

What Mr.Chong is admitting to is if we had mandatory screening,
you would find an overwhelming amount of minorities with Hepatitis,
AIDS and one he never mentioned Tuberculous. So, what should
we do? Stick our head in the sand and hope it will go away?
Or do we pass laws to protect people with contagious disseise? 

Let me use this example: 
Let say  you live in a small northern town and a forest-
fire breaks-out 20 Kilometres from town. What do you do?
Do you pass laws to protect the forest fire? Do you round up
all the people in the town to educate them that forest fires are really OK
and to be scared of it means you have a mental problem! 
Do we give government money by the millions to develop programs to
teach people that the forest fire is the fault of all the "racist"
people and all the Fireophobic people are really the one who
should be dealt with? 
Or do we pass new "hate" law to stop people from yelling at the
sight of smoke "FIRE," because you don't want to expose fire to any
contempt or scone do you??

In real life what happens what a Forest fire breaks out?

After I stopped puking, I had to respond to this utter nonsense
spewed by Mr.Chong

You must ask yourself this basic question: Who has more rights
the majority or the minority? Canada is a so-called democracy right? 
if this is so, why is it the minorities have all the rights?

What Mr.Chong is admitting to is if we had mandatory screening,
you would find an overwhelming amount of minorities with Hepatitis,
AIDS and one he never mentioned Tuberculous. So, what should
we do? Stick our head in the sand and hope it will go away?
Or do we pass laws to protect people with contagious disseise? 

Let me use this example: 
Let say  you live in a small northern town and a forest-
fire breaks-out 20 Kilometres from town. What do you do?
Do you pass laws to protect the forest fire? Do you round up
all the people in the town to educate them that forest fires are really OK
and to be scared of it means you have a mental problem! 
Do we give government money by the millions to develop programs to
teach people that the forest fire is the fault of all the "racist"
people and all the Fireophobic people are really the one who
should be dealt with? 
Or do we pass new "hate" law to stop people from yelling at the
sight of smoke "FIRE," because you don't want to expose fire to any
contempt or scone do you??

In real life what happens what a Forest fire breaks out?
Every able-bodied man gets off his ass, goes into the forest
and STOMPS OUT THE FIRE!!!

Get the point....
